I Just received this from Sgt. Taylor. This is pretty interesting. Still no photo but I'm sure one is on the way. :lol:

just got an update on the Jerry Napier case. According to court records, his trial was to be this month, but was pushed back until April at his attorney’s request. Last Tuesday, he filed a motion with the court to plead guilty to the charges.

I received info from Richmond that stated that he plead guilty to a Class D felony, which meant up to 3 years in jail. However, it also stated that it was the judge's discretion as to altering the Class D felony to a Class A misdemeanor.

I can post more details from the letter if anyone is interested; mostly just a lot of legal talk, but still very good news overall for us.

Is there anyway to get a copy of the court proceedings?
I would like to read word for word what was said it court on this.
I tried getting it online, but they wanted to charge me for the information- I thought this was a FREE PUBLIC RECORD!!!

Public Records are available to the public for a fee. It's our government (in one form or another) and just because we pay for it doesn't mean it serves our needs for free. Or is even there when we need it. Try to find a cop when you're being held up in a parking lot at 3a.m.

I guess if I lived near Wayne County Indiana, I could just pop into the court house and ask for a copy of the court record. But...since that is a bit out of my way, it seems like the court should make that record available to the general public online and for free? Especially in this case, since one of the people involved in this (Austeyr) can't just jump on a plane from half way across the world to see a copy of this record. :evil:

Copying the record still costs in time and money- the paper, the clerk's time standing there waiting for dozens(!?) of pages to copy out.... That is time away from more pressing public business like running out for doughnuts to go with the designer coffee brewing in the break room.

We turn thousands of documents from physical copies to image files each week. You throw a stack into the copy machine and bim-bam-boom it is done. Takes about 10 seconds a page and nobody even needs to hover over it. Donuts and coffee is what it is though. :D

My last contact from the Sarge was waaay back in Sept 07 so I wonder what's been happening. I had sent the paperwork back but have not heard anything.
I did get a call at my folks house late last year from an american woman who said she would call again at my new address but alas, nothing.
I do hope I get the Zero back and this dude Mr Napier gets one jammed in his..... well you know.
It'd be good to know if I will actually be getting it back.

olifant: I presume you are using an editorial we and are yourself presuming that the local court involved is technologically current. They may not have or regularly use scanners. I do expect that they have a Mr. Coffee of some sort however.

This has just gone on soooooooooooo long, I am sure it will not end with us being happy about the outcome.

If people are getting away with murdering people, do we have any hope of a serious sentence for a bozo stealing toys. I feel he'll get away with it....... if we ever find out..

Most likely he will receive a fine, probation, he could possibly get a few days in jail, but I would be surprised if it is any more than that. With the way the legal sytem is in this country, well like TTT said there are people getting away with murder.

After reading the posts wondering what's going on with our buddy Jerry Napier,
I decided to email Sgt. Taylor to see if I could gather any info. He replied with this.

On June 9th, 2008 Jerry Napier pled guilty to all six counts theft. As he was a first time offender, he was sentenced to 3 years in prison, however, that was suspended. He was placed on home arrest for 120 days, and probation for the remainder of the term of his sentence time. He was ordered to pay restitution in full, and at that time when restitution was paid the class D felony (the lowest class felony in Indiana) are going to become Class A misdemeanors. Should he not pay restitution, or violate the terms of his probation, his crimes will stay a D Felony, and he’ll be placed in prison for the length of the sentence.



As soon as we get a notice from the Prosecutor’s Office, we can start releasing stuff that we know who it belongs to. We may have a problem with the actual “soldiers” as there are many of them, and I’m not up to snuff on who is who and from what series, etc. We’ll cross that bridge when we get there.



I’ll periodically check with the evidence tech to see if any release order has come down from the prosecutor’s office.
