I don't believe you have to be able to provide conclusive proof for each and every item. Send a list of what you sent the defendant, and they will try to match it with the evidence they recovered.

Just sent Lt Taylor an e-mail asking if he wants my list, accurate or not. I don't care what or if I get anything back, I just don't want anything returned to Napier and he ends up thinking he got away with it after all.

My response from Lt Taylor. As I read it he's not too happy with the situation either but this the way it is. I'm not certain how to proceed at this point, I don't have any photos of my items but I can get generic photos from the Database. Any suggestions? Again, I'm not particularly looking to get anything back; but just to keep it from going back to Napier.

"Mr. XXX,

Unfortunately, the things were taken from Mr. Napier on a search warrant,
and anything we cannot positively ID as stolen will be returned to him. I
know as well as you that most of it was indeed stolen, however, if a
victim didn't come forward in the nearly 2 years that this case took to
get kicked off, I can't promise that the items will be returned, since
this case has already been adjudicated.

Please send me your list of items. It needs to be very, very detailed.
If it consists of figures, I'll do my best to weed through them. You WILL
need to provide a picture of each figure that you sent. If you sent a
vehicle, you will need to provide a photo as well. Your chances of having
a vehicle returned are much greater than a figure. I'm sorry, that's due
to me not knowing which figure is from which series, etc. Mr. Napier did
a lot of cutting and butchering of the figures, as Razor and Grunt can
attest to, and it took them several hours just to find the correct
pieces/accessories for the figures the victims had come forward and said
were missing.

I'll be on vacation until the 3rd of February. I'll touch base with
evidence lab to find out how best to handle this, as they have already
sent Mr. Napier a "come get your stuff" letter. If he has picked up the
items by the time I get back, there is absolutely nothing I can do about
it. I am hoping, however, that the items are not claimed within 30 days
so that they'll go to auction. If this happens, the auction may or may
not be this year, and I'll make every effort to contact Razor and/or
Grunt1 to let them know (as they're the closest to Richmond, IN). It is
my hope that the stuff will go for a few bucks, and then find its way back
to the Warbirds community.

GREAT NEWS!!!!!!
The last item that Jerry Napier took from the members of this board has been RECLAIMED!!!
Our XD brother in Australia, Austeyr's customer green Zero was picked up from the Richmond Police Department today by me. (looks in really good shape) It will be readied for shipping and sent out on Monday to Austeyr with the shipping tab being generously picked up by Grunt.
Thanks go out the Lt. Chris Taylor of the Richmond Police Dept., who made himself available on a Saturday for the pickup to be made.
Sometimes justice takes a long time to be served, but when it does - it's SWEET!

Gentlemen,

I would like to express the deepest most sincere of thankyou to both Razor Grunt and Lt.Taylor.
I have received my green zero today and yes I am extremely surprised at the condition also. I am only missing the belly long range fuel tank and the sword from the pilot. A very very very lucky return you could say. NOTHING on the Zero was broken or butchered as I thought it was going to be. You guys have meant a great deal to me through the whole process of bringing down the scum that this man is. A pathetic lowlife who I honestly deserved a harsher sentence.
Please could Grunt and Razor both send me your telephone numbers as come the weekend I would like to personally call you and say thanks. I will also be calling Lt Taylor.
Again I can not say thankyou enough but good deeds to get returned and I am hoping that at some point you fine gentlemen may need my help for something and I can return the favour. Maybe even catch up for a beer when I hit state side for the Vegas AMA next year in May. I will be travelling after wards and seeing the sights your fine country has to offer.
Again, thanks to all those involved and a somber "sorry" to all of those who did not get things returned or had them returned in bad condition. I lurk a lot here but I should pipe up more than I do.
